Motorola-Klage: Verkaufsstopp für iPhones und iPads in Deutschland vorübergehend ausgesetzt
Das Mitte Dezember erlangte Urteil für ein Verkaufsstopp für iPhones und iPads, das durch eine Patent-Klage von Motorola erreicht wurde, wurde jetzt umgesetzt: musste gestern für einige Stunden alle UMTS-fähigen Mobilgeräte (also 3GS, , iPad und iPad 2; nicht aber das iPhone 4S) aus dem Sortiment des Online Stores nehmen.
Innerhalb weniger Stunden konnte Apple vorübergehenden Aufschub erreichen, und den Lieferstatus von „Derzeit nicht verfügbar“ wieder auf „Lieferbar“ ändern.

I can confirm that we were granted a suspension of the injunction, and updated our statement to the following. All iPad and iPhone models will be back on sale through Apple's online store in Germany shortly. Apple appealed this ruling because repeatedly refuses to license this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago.

Dieses Aussetzen der Urteilsvollstreckung könnte aber nur von kurzer Dauer sein: Florian Müller von FOSS Patents spricht von „möglicherweise nur wenigen Tagen oder Wochen“ – genauer gesagt bis zu einer Entscheidung des Berufungsgerichts, ob ein kürzliches Angebot an Motorola die Sachlage deutlich verändert oder nicht.
Schlimmstenfalls könnte das Verkaufsverbot in Deutschland bis zum Ende des Verfahrens andauern.

More than a week ago, Apple already tried to win a suspension of the injunction, also arguing that it had made a new offer to Motorola. That first motion to stay was denied by the appeals court. But Apple amended its offer again, and its second motion to stay was granted, though at this stage only until the appeals court decides, based not only on Apple's motion but also on Motorola's reaction to that new offer. At that point, the appeals court could extend the stay (for example, until the end of the appeals process) or it could let the enforcement of the injunction resume.

Anmerkung: Der betraf bisher nur den Apple Online Store, und nicht Apple Retail Stores oder Wiederverkäufer. Motorola strebt jedoch auch hier einen Verkaufsstopp an.

Wie jetzt bekannt wurde, klagte Motorola im vergangenen Jahr gegen die Verletzung drei weiterer Patente, zwei davon FRAND-Patente (für technische Standards), und ein nicht-FRAND Patent.
