Samsung vs. Apple

Im Patentstreit zwischen und hat sich eine überraschende Wendung ergeben: Samsung hat in Deutschland seine Klage wegen Patenverletzung durch Apple's iPhone 4S zurückgezogen, weil bekannt wurde, dass ein Lizenzabkommen mit Qualcomm auch die Nutzung durch Apple rechtmäßig macht:

“Other news from Mannheim: Samsung has formally given up attacking the 4S with 3G patents. Recognizes Apple is licensed thru Qualcomm,” tweeted Mueller on Dec. 16.

Kurz darauf startete Samsung allerdings einen neuen Angriff aufgrund vier neuer :

These are the four new patents:

two new FRAND-pledged declared-essential patents (I'm surprised that Samsung brings in such patents despite the European Commission's ongoing preliminary investigation into what might constitute abuse of standards-essential patents):

EP1720373 on a „method and apparatus for reporting inter-frequency measurement using RACH message in a communication system“; this one was previously asserted in France and Italy; it's the post-grant equivalent of U.S. Patent Application No. 2006/0252377

EP1679803 on a „method for configuring gain factors for uplink service in radio telecommunication system“; this is the equivalent of U.S. Patent No. 7,668,563

two patents that are not standards-related:

DE10040386 on a „speech output device for data displayed on mobile telephone converts data from display into speech data for output via loudspeaker“

EP1215867 on an „emoticon input method for mobile terminal“ 🙂

Smiley or not, patents are serious business.

Erst kürzlich wurde in Frankreich eine Samsung-Klage gegen Apple abgelehnt:

“Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology,” said Samsung in October, regarding its first filing complaint in France. “We believe it is now necessary to take legal action to protect our innovation.”

In Australien, wo das Galaxy Tab 10.1 seit kurzem doch verkauft werden darf, nutzt Samsung jedoch das Medieninteresse am Patent-Disput: „The tablet Apple tried to stop“
